Terms of Service

The agreement between you and Pistaclub when you use the platform.

These Terms of Service ("Terms") govern your use of Pistaclub — the website, mobile apps, and related services we operate (together, the "Service"). By creating an account or otherwise using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

1. Who we are

2. What Pistaclub is — and is not

Pistaclub is a neutral intermediary information society service within the meaning of the EU e-Commerce Directive (2000/31/EC) and the EU Digital Services Act. We host content posted by users and organizers, provide search and discovery tools, and facilitate messaging and bookings between our members.

We are not:

  • An event organizer, promoter, or race promoter.
  • A seller, reseller, importer, or distributor of any goods listed in the marketplace.
  • A transport, escrow, or payment institution (payments are processed by Stripe or transferred directly between users; see §8).
  • A safety, mechanical, medical, insurance, tax, or legal advisor.
  • A party to any contract you form with an event organizer, seller, or other user through the Service.

All rider ↔ organizer bookings and buyer ↔ seller sales are contracts between you and the other user. Pistaclub provides the listing, communication, and (for organizers who opt in) the payment rail as a facilitator only.

3. Who can use it

You must be at least 16 years old to create an account (Privacy Policy §11 explains why we chose this floor). By using the Service you confirm that you meet this age requirement, that you have the legal capacity to enter into these Terms, and that the information you provide about yourself is accurate.

4. Content you post

You keep ownership of the content you create on Pistaclub — your posts, photos, videos, laptimes, reviews, and listings remain yours. By posting, you grant us a worldwide, non-exclusive, royalty-free licence to host, display, distribute, cache, resize, and reasonably promote your content within the Service and its marketing surfaces. You also grant other users the right to view and interact with your content per the visibility settings you choose. This licence ends when you delete the content, except where the content has been shared with others (e.g., quoted in a thread) or where we must retain it for legal, safety, or evidence reasons (see §7 below and Privacy Policy §9).

You are solely responsible for everything you post. Don't post anything that violates our Community Guidelines, infringes anyone else's rights, or is illegal where you live or where Pistaclub operates.

5. Our content and trademarks

The Pistaclub name, logo, design, code, and editorial content (guides, articles, and curated information about tracks, organizers, and events) are owned by us or our licensors. You may not copy, redistribute, or build derivative products from this material without written permission.

6. Acceptable use

Don't use the Service to:

  • Break our Community Guidelines.
  • Scrape, mass-download, or otherwise extract data from the Service in ways that bypass normal user-facing access.
  • Reverse-engineer the platform, probe for vulnerabilities except via a coordinated disclosure, or interfere with how the Service runs for other people.
  • Use bots, scripts, or automated agents to post, react, or message — unless we've explicitly invited that integration.
  • Resell access to the Service or use it as backend infrastructure for a competing product.
  • Circumvent moderation, block, or safety mechanisms — including creating alt accounts after a ban.

7. Moderation, enforcement, and retention

We can remove content, restrict accounts, suspend users, or permanently ban users for violating these Terms or the Community Guidelines. We try to do this proportionately and transparently — see the Guidelines for the strike system and the DSA-compliant appeal process. Every action is logged in an internal audit trail; you can request information about actions taken against your own account.

How long we keep moderation data. To meet our legal obligations under the EU Digital Services Act and to defend against unfounded complaints, we retain moderation records for the following periods:

  • Moderation actions taken on your account or content(warnings, suspensions, content hidden/removed): 5 years from the date of the action.
  • Reports that were acted on: 5 years, tied to the action they justified.
  • Reports that were dismissed or duplicate: 1 year, after which the reporter's identity and any free-text detail are irreversibly anonymised.
  • Appeals you file: 5 years (matches the underlying action).
  • Per-event chat mutes that have been lifted: 1 year after they are lifted.
  • Track-moderator assignments that have ended: 5 years after deactivation.
  • Phone-verification OTP records: 30 days from issue.
  • Annual transparency reports: kept indefinitely as a permanent public record (aggregate data only — no identifiers).

Retention is enforced by a recurring automated job. Our full record of processing activities (GDPR Art. 30) is maintained internally.

8. The marketplace

Pistaclub lets riders list bikes, gear, and parts for sale to other members. We are not a party to any sale. Sellers and buyers are responsible for negotiating price and condition, arranging payment and delivery, and resolving any disputes between themselves.

We may remove listings that violate the Guidelines (fraud, stolen goods, counterfeit items, unsafe modifications, prohibited categories, etc.), but we do not vet every listing individually and we make no warranty as to the accuracy, quality, safety, roadworthiness, or legal status of any listed item. Use common sense: inspect items before paying, verify the seller's identity, prefer in-person handover when possible, and rely on your own judgement.

9. Events and organizer content

Trackday organizers can publish events, accept registrations, sign waivers, and communicate with participants through Pistaclub.Bookings, refunds, cancellations, waiver enforcement, and on-track conduct are contracts between you and the organizer. Pistaclub provides the listing, the communication layer, and (where the organizer opts in) a Stripe-processed payment rail as a facilitator only. We are not a party to that contract and have no on-track presence, authority, or supervision.

The organizer's own terms, cancellation policy, waiver, and privacy notice govern your relationship with them. Where those terms conflict with these Terms as applied to Pistaclub itself, these Terms prevail; where they conflict on matters between you and the organizer, their terms prevail as between you and them.

Organizers are separately bound by our Organizer Terms and the associated Data Processing Agreement, which include their responsibilities as controllers of rider data, insurance obligations, and the platform-fee mechanics. Those documents are published for transparency but govern the platform ↔ organizer relationship — riders' relationship with an organizer remains governed by that organizer's own event terms and waiver.

Photographs sold by organizers. Where an organizer offers event photographs for sale, the organizer is the seller and we are not a party to that sale. We provide the platform, process the payment on the organizer's behalf, and retain a platform fee. Your rights in a photograph you buy are set out in the Photo Licence; your rights over photographs of you — including having one removed and withheld from sale — are in the Photo Consent & Auto-Tagging Policy.

10. Assumption of risk — motorcycle track riding

Riding motorcycles on a racetrack is an inherently dangerous activity that can result in serious personal injury, permanent disability, or death, and can damage or destroy expensive equipment. These risks arise from — among other things — high speeds, rider error, mechanical failure, other riders' behaviour, weather, track surface conditions, and the physical limits of protective gear.

By using the Service you acknowledge and accept these risks. Nothing on Pistaclub — including event listings, organizer profiles, track pages, gear discussions, editorial guides, community posts, laptime rankings, photos, videos, or any AI-assisted feature — constitutes professional safety, mechanical, medical, insurance, tax, or legal advice. You ride entirely at your own risk. Always follow the organizer's briefing, wear appropriate homologated protective gear, maintain your motorcycle in track-safe condition, ride within your own ability, and carry appropriate insurance.

Where you use Pistaclub to book an event, you separately sign the organizer's waiver and risk acknowledgement. That waiver — and the organizer's own rules — control what happens on track.

11. Release of Pistaclub

To the fullest extent permitted by applicable law, you release, waive, and hold harmless Pistaclub, its owners, employees, contractors, and service providers from any and all claims, demands, losses, damages, costs, and expenses (including reasonable legal fees) arising out of or connected with:

  • Any injury, death, or property damage you sustain while riding at any event you learned about, booked, or otherwise engaged with through the Service;
  • Any dispute between you and an event organizer, seller, buyer, or other user of the Service — including refunds, cancellations, defective goods, non-delivery, and disagreements over event conduct;
  • Any user-generated content posted by anyone other than us — including reviews, comments, laptime claims, photos, and listings;
  • Any inaccuracy in editorial content, translations, AI-assisted suggestions, or third-party data displayed on the Service.

This release does not exclude liability that cannot be excluded under applicable law (including EU consumer-protection law and mandatory national law), nor does it apply to Pistaclub's own gross negligence or wilful misconduct.

12. Warranty disclaimer

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory — including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, error-free, translated accurately, or free of harmful components.

Automated translations of user- and organizer-generated content are provided as a convenience. They may contain errors and are not an official translation. The original text is always accessible via the "Show original" toggle. When in doubt — especially for safety-critical information such as event requirements, restrictions, and waivers — rely on the original language version.

13. Limitation of liability

To the maximum extent allowed by applicable law, Pistaclubis not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, nor for loss of profits, revenue, data, goodwill, or use, arising out of or in connection with your use of the Service — even if we have been advised of the possibility of such damages.

Aggregate cap. Our total aggregate liability to you for any and all claims arising out of or relating to these Terms or the Service is limited to the greater of (a) the amounts you paid us (if any) in the 12 months before the event giving rise to the claim, or (b) EUR 100.

Nothing in these Terms excludes or limits liability that cannot be excluded under EU consumer law, the laws of your country of residence, or other mandatory law — including liability for death or personal injury caused by our negligence, or for fraud.

14. Your indemnity of Pistaclub

You agree to indemnify and hold harmless Pistaclubagainst any claim brought by a third party arising from (a) content you post, (b) your breach of these Terms or the Community Guidelines, (c) your infringement of any third party's rights, or (d) your conduct toward another user of the Service. This obligation applies to reasonable legal costs actually incurred and only to the extent the underlying claim is upheld or settled with your written consent.

15. Ending the relationship

You can stop using Pistaclub at any time. Delete your account from your profile settings — your personal data is handled per our Privacy Policy, the EU GDPR, the UK GDPR, and Brazil's LGPD where applicable.

We can suspend or terminate your access if you materially or repeatedly violate these Terms or the Community Guidelines, or if we're legally required to do so. We'll give you reasonable prior notice except where doing so would cause harm or where the violation is severe (illegal content, doxxing, fraud, credible safety threats, etc.). Sections that by their nature should survive termination — including §4 (licence to content already shared), §7 (retention), §10–14 (risk, release, disclaimer, liability cap, indemnity) — survive.

16. Changes to these Terms

We may update these Terms as the Service evolves or to reflect legal changes. Material changes will be announced in-app and via email where we have one on file. You will be asked to actively re-accept the updated Terms before continuing to use the Service. If you disagree with a material change, you have 30 days of read-only access to export your data and cancel any active subscription before the change applies to you. The "Last updated" date above tells you when the current version took effect.

17. Governing law and disputes

These Terms are governed by the laws of the Czech Republic, without regard to conflict-of-laws principles. Courts in Prague have non-exclusive jurisdiction over any dispute, except where mandatory EU consumer law gives you the right to bring a claim in your country of residence.

Nothing in these Terms prevents either party from seeking urgent injunctive or equitable relief in any competent court, or from bringing a small-claims action within the ordinary jurisdiction of a consumer court where applicable.
