These Marketplace Terms govern your use of the Pistaclub Marketplace. The Marketplace is a notice-board for private sellers and registered traders to list motorcycles, parts, gear, tires, transport equipment, and event tickets for sale to other users. Pistaclub is not a party to any sale, does not inspect or warrant listed items, does not ship goods, and does not process buyer payments (except for event tickets bought through the in-app booking flow, which is covered separately by our Payment Terms).
Pistaclub is an information society service under the EU e-Commerce Directive 2000/31 and a hosting service under the Digital Services Act (Regulation 2022/2065). We store and display listings authored by users; we do not select, edit, endorse, or verify listing content beyond acting on notices of illegal content per our notice-and-action mechanism.
All contracts formed through the Marketplace are between the buyer and the seller. Pistaclub is not the merchant of record, does not take payment for third-party goods, does not act as an escrow, and does not mediate disputes.
When you list an item you must classify yourself as either a private individual or a business / trader. This classification determines the buyer's rights and is required by EU Consumer Rights Directive 2011/83 and Digital Services Act Article 30.
You are selling as a private individual if you are disposing of an item you own for a non-commercial purpose (e.g. selling your own motorcycle, spare gear you no longer need). The 14-day withdrawal right and statutory warranty do NOT apply — the sale is between you and another private party. Buyers must inspect the item and satisfy themselves of its condition before purchasing.
You are a trader if you sell in the course of a trade, business, craft or profession — even without a registered company. Regularity, volume, and buying-to-resell are the strongest indicators. As a trader you owe every consumer buyer:
Pistaclub renders your trader details on every listing you post; failing to keep them accurate is grounds for suspension. Misclassification of a trading account as "private" to evade consumer protections is a violation of both these Terms and applicable law.
When a user posts more than three listings in a 90-day window while still classified as "private", the platform shows an advisory that the user may qualify as a trader. This is a reminder — not a legal determination. The threshold varies by jurisdiction and product value; consult local counsel if unsure.
When you contact a seller, check the seller-type badge on the listing:
Listings of stolen goods, counterfeit parts, safety-critical items known to be defective, items subject to product recalls, or items you do not lawfully own or are not authorised to sell are prohibited. See our Community Guidelines for the full list. Prohibited listings are removed on discovery or on notice via our notice-and-action mechanism.
Pistaclub does NOT process payment for third-party marketplace goods. Buyer and seller settle directly. For event-ticket listings that resolve to an in-app booking, our Payment Terms apply to the ticket transfer itself. All refund and payment disputes for other listings are between buyer and seller.
Pistaclub does not mediate disputes between buyer and seller. If a transaction goes wrong:
We can provide transparency exports (listing content, messaging history) on lawful request from a party to the dispute or from a competent authority, but we do not adjudicate.

We reserve the right to hide, delete, or refuse listings that violate these Terms, our Community Guidelines, or applicable law. Sellers whose listings are repeatedly removed may be suspended or banned per our general Terms of Service.
We may update these Marketplace Terms; material changes will be communicated to active sellers and will trigger a re-acceptance flow on next login. See our Terms of Service for the general change-notification process.
